Payment for Trek/Adventure Activity:


When you purchase any travel services from Himalayan Outdoor Tour (hereafter referred to as ‘HOT’), it establishes a contractual arrangement between HOT (‘First Party’) and you (hereafter referred to as ‘Client’ or ‘You’) (‘Second Party’). Both parties are collectively referred to as ‘Parties.’ By booking services with HOT, you unconditionally accept the terms and conditions outlined herein. These terms are binding on you and all travel companions booked by you.

Trekking, peak climbing, and mountaineering in the Himalayan region entail inherent risks to the life and property of both Parties. Weather changes can occur rapidly, leading to injuries and fatalities beyond HOT’s control. While HOT strives to minimize risks and hazards to the best of its ability, there is still a chance of accidents, mishaps, and service deficiencies. Therefore, you must agree to these terms and conditions. It is essential to carefully read and understand these terms before confirming your booking.

Promotions:


The images displayed on the website and promotional materials are for marketing purposes only. They do not guarantee the inclusion of visual content in your vacation experience or any assurance that you will encounter or witness what is depicted in the pictures.

Fitness Responsibility:


HOT offers trips and treks with varying levels of fitness requirements, based on physical stress, terrain, weather, and climate. Some trips may be physically demanding, and it is your responsibility to assess and prepare accordingly. While HOT is not a medical expert, it is your duty to seek medical advice, including vaccinations, before joining a trip. HOT takes no responsibility for your ability to cope with the trip’s difficulty level. You must be fit, healthy, and adequately equipped for the trip, and any relevant conditions or disabilities must be disclosed during the booking. Failure to share this information can lead to immediate termination of the trip with full cancellation penalties.

Program Dates:


You are responsible for verifying the correct dates mentioned on your travel documents.

Documents:


Ensure all necessary documents are presented in advance. HOT is not accountable for any incomplete trip formalities or the absence of essential papers.

Itinerary:


HOT prioritizes your safety and enjoyment and reserves the right to modify or cancel a trip or part of it under circumstances beyond its control. Any additional costs arising from such changes are borne by you.

Refund:


No refund, partial or otherwise, will be made if you voluntarily leave a trip after it has begun. Refunds are not possible for missed or unused services.

Communication:


All communication will be conducted through the email ID provided in the registration form. HOT is not responsible for loss or delay of communication due to incorrect email IDs.

Luggage Responsibility:


Baggage and personal effects are at your risk throughout the trip. You are solely responsible for your belongings, and HOT is not liable for any loss.

On-trip Behavior:


You must behave in a manner conducive to group travel. HOT reserves the right to terminate your trip if your behavior causes distress or endangers others, with no refund for unused services.

Amenities:


While HOT strives for guest comfort, amenities in the Himalayan region may differ from those at home. Patience and preparedness for compromises are essential.

Extra Expenses:


Inclusions vary for each trip, and extra expenses such as insurance, airfares, visas, and optional activities are not included unless specified.

Awareness:


You acknowledge the inherent risks and challenges of adventure travel, assuming all responsibility for personal risks and releasing HOT from claims arising from such risks.

In case of emergency:


You are responsible for all expenses related to illness or accidents during the trip.

Third Party:


HOT hires third-party professionals, and you absolve HOT from liabilities arising from their services.

Photography Rights:


HOT reserves the right to use photographs and videos for promotional purposes, obtained through email, WhatsApp, or website links, without prior consent or compensation.

Optional Activities:


Activities not included in the trip do not bind HOT, and your contract for such activities is with the provider.

The website’s content is subject to change without notice. No warranty or guarantee is provided for accuracy, timeliness, or performance. Any dispute is subject to Indian laws.
